Does a superannuation fund own Australian National Car Parks?

Recently an irate victim of Australian National Car Parks rang Barkly Square Shopping Complex which has an ANCP car park at the rear and asked them why they are supporting this organization. The complainant was informed that the owner, a 'prestigious' and well known super fund would not be doing anything illegal or wrong.

The complainant was also informed that there is nothing wrong with the way in which ANCP operates, demanding 'damages' from drivers and issuing real-looking fines which are in fact not fines and SHOULD NOT BE PAID.

Here is yet another of the evil letters they send out to victims, often years after the alleged 'offence', which might consist of:

*just driving into an Australian National Car Park then driving out again
*being too slow to get a ticket out of the machine
*driving past an ANCP on a public road
*thinking about entering an ANCP

The person who received this letter from ANCP has every legal right to park in their space because his employer has an arrangement with the shopping centre. Yet he is often issued with these demands to pay $88 and has been hounded about this once since 2007.

He is standing firm and WILL NOT PAY.

Definitely do not pay these "fines". This is a blatant scam. What authority do these people have to issue "fines". Come on.

Such letters of demand to pay should be answered by a Notice of Conditional Acceptance saying you will pay (this nullifies any claim by them that you refuse to pay an alleged debt), but ANCP must first provide a certified copy of the legislation that enables ANCP, a private company, to issue fines; show in the legislation what "offences" are listed and what fines are to be paid; show what contract you entered into and signed with ANCP that states that you agreed to pay a fine for certain activities.

Make sure you sign and date your letter properly and make three copies.

I doubt the ANCP would even answer it, in which case they are in default. But not only that, they should be made accountable for making unwarranted threats or fraudulent claims to deprive you of money.

I got a fine... and now ignore the countless threatening letters warning me to pay "or else". I also now park there regularly without getting a ticket. Bring on the fines... they will not be getting paid.

It looks like these days everyone has the authority to issue fines with no solid grounds. We shouldn't accept that and we should stand for our rights otherwise more 'fines' will come. The person who received the letter from ANCP should appeal a legal court for that. What's next, higher taxes and higher automobile insurance?
